Work Place Harassment

Have you ever felt uncomfortable at work due to crude jokes based on race? Have you or others been the subject of unwelcome physical advances and/or sexually offensive behavior? Is your work environment so intimidating that you fear retaliation if you report the conduct?

You may be the victim of a type of harassment called "Hostile Work Environment Harassment." This type of harassment is defined as unwelcome comments and/or conduct based on protected characteristics (such as race, sex, age, etc) that create an intimidating, hostile, or offensive work environment. Who could miss the media blitz surrounding the claims of discrimination and harassment brought against Paula Deen by a former employee? The employee, who had worked in Paula Deen's famous "Uncle Bubba's Seafood & Oyster House" in Savannah, Georgia, made, among other allegations, claims of sexual and racial discrimination during her tenure at the restaurant. The case was eventually settled out of court.

Another type of work place harassment occurs when a supervisor's offensive conduct results in a tangible change in an employee's status or benefits, perhaps in retaliation for the employee's refusal of unwanted advances and attention. Sometimes an adverse employment decision does not result from harassment, but rather a beneficial change in status, such as a raise or promotion. This kind of harassment is known as Quid Pro Quo Harassment, and is just as illegal.
